Terms and Waiver

Please read the following and all pages linked carefully. By clicking yes below, you are agreeing that you have read this in its entirety and agree with its contents.

Release from Liability

You (the Participant named above) have requested to participate in the Activity on property owned by Holtwood, LLC (“Holtwood”). In exchange for permission from Holtwood for the Activity to take place on Holtwood property, you agree to the following:

 

You hereby release and forever discharge Holtwood, its affiliates, and their respective directors, officers, employees, agents, successors and assigns (“Holtwood Parties”) from all claims, demands, and causes of action that you, your representatives or your family may now have, or that may accrue in the future, whether known or unknown at the time of this Release, arising out of or in any manner relating to the Activity.

 

You agree to indemnify Holtwood Parties for any loss or liability, including the costs of settlements, judgments, damages and expenses including reasonable attorneys fees, from all losses, damages and claims (“Claims”), at law or in equity, whether based on statute or regulation or on theories of contract, tort, negligence strict liability, or otherwise, which are brought by or on behalf of anyone other than Holtwood Parties or you for injuries or damages to persons or property arising from or in any manner from your acts or omissions relating to the Activity, whether arising from or relating solely to your acts or omissions or arising from or relating to acts or omissions of both you and Holtwood Parties. You will defend, at your own expense and with counsel acceptable to Holtwood, any suit or action brought against Holtwood Parties based upon any such Claims, whether arising from or relating to acts or omissions of Holtwood Parties or arising from or relating to acts or omissions of both you and Holtwood Parties.

 

This Participant Permission Form is governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania without regard to its rules regarding conflicts of laws. By signing below, you agree (or your parent/guardian agrees on your behalf if you are under 18) to be bound by the terms and conditions.

All players will be required to sign the Release & Waiver form at time of Check-in on Friday, February 19, 2016. No players will be allowed to participate without signing this waiver.

 

All players must sign a liability release form at the tournament registration, prior to all tournament games, acknowledging they understand and accept that there are risks involved in participating in any and all recreational activity, are aware of those risks, and are voluntarily participating in the WIF with knowledge of the risks involved. All players agree to accept and all such risks of injury, death and/or property damage or loss. In consideration for being allowed to participate in this activity, all players agree to the terms of this waiver, release, covenant not to sue and indemnity agreement as set forth herein. All players, on behalf of themselves, their heirs, next of kin, assigns and personal representative will waive, release, absolve, indemnify and agree to hold harmless the WIF Pond Hockey Tournament, the Chamber of the Northern Poconos, and its subsidiaries, all WIF sponsors, and all members, officers, directors, employees, volunteers, or any other representatives of the WIF, against any and all causes of action, claims, demands, losses, expenses, liability.

We reserve the right to use the names and photos of registered team members and team names for all tournament promotion, including the website, press releases, media and marketing.

Injury Policy

Unfortunately, injuries are a natural occurrence in a contact sport such as hockey. As a result, refunds will not, and cannot, be given for injuries.

Refund Policy

By registering for this tournament, you and your team agree to all waivers & statements on this registration form. Should you cancel prior to January 30, 2016, you will receive 1/3 of your total registration fee back. If you should cancel after January 30, 2016, no refund will be given and all monies paid will be forfeited.

Weather Cancellation Policy

Tournament directors will make all decisions on ice and weather safety. The WIF Pond Hockey Tournament is not liable for your team’s travel, such as, but not limited to air travel, lodging expenses, auto rental, and personal auto travel. If the event is cancelled prior to February 20th, 2016 due to weather or ice conditions, your team has two options:

  1. You may hold your team spot for the 2017 WIF Pond Hockey Tournament
  2. You may receive 25% refund of the registration fee back.
